S278 Legal Agreement

The procedure required to reach an agreement can take time and time, and it is therefore desirable to get in touch as soon as possible with the authority of the motorways. Section 278 of the agreements is generally the local authority that authorizes the developer to carry out the proposed work. Sometimes the highway service does the work, or the developer can pay the highway service to do the job if it`s comfortable for the developer`s schedule. The following construction practice note contains complete and up-to-date legal information: if the developer does not provide agreed payments or if the work is not carried out in accordance with the contract, the motorway authority has the power to close access to the site. Inspection and maintenance costs are payable before the legal agreement is reached. Payment details are included in the application forms. A Section 278 (or S278) agreement is a section of Highway 1980 that allows developers to enter into a legal agreement with the Council (as a Highway Authority) to make permanent modifications or improvements to a public highway as part of a plan. The s38 agreements concern the maintenance of new motorways by road authorities and the building permit must be issued before it is possible to seize them. The agreement contains details of the building permit, technical drawings, construction program and inspection. A corresponding tax covers the cost of these items.

An S278 agreement usually includes one or more of the following agreements: The Road Agreements team is responsible for S38, S278 and private road agreements. They carry out technical checks, agreement management, local inspection and takeover of the S38 and S278 plants. In Birmingham, we normally use s278 agreements to allow designers to employ a contractor in road construction and for that contractor to work on the existing public highway, as we, the motorway authority, would carry out work. The proponent is responsible for all aspects of the public highway work, from planning to monitoring the construction and ensuring that the work is completed to our satisfaction. « A motorway authority, if they are satisfied that it will be useful to the public, can reach an agreement with only one person – the Section 278 agreement is a legally binding document between the local road authority and the developer to ensure that work on the motorway is completed according to the standards and satisfaction of the local motorway authority. As a general rule, the proponent intends that once this work is completed, these new and/or modified highways will be taken over and maintained by the local motorway authority (LHA). As a result, the agreements concluded under Highway 1980 – particularly in this context, Sections 38 and 278 – are generally concluded between the LHA and the proponent to ensure the delivery of necessary or agreed-upon highway work to the necessary standards. The document is prepared by the lawyer of the local highway authority and issued to the developer`s lawyer in the form of design. The details of the agreement will then be agreed before the final document is finalized and signed by both parties before the start of field work.
